Definitions

Zixxi is part of River Associates Limited, and specialises in the creation, manufacture and sale of lithographic, digital and mixed-media wall art and installations. Our terms of business apply to any use of these services and all orders are placed subject to the following Terms & Conditions - please read them carefully. For the purposes of these terms, "you/your" is defined as the customer, browsing our website prior to engaging in the purchase of products from Zixxi. "We/our" is Zixxi, who will accept an offer to purchase goods, confirm the order, supply and subsequently arrange for delivery of those goods on receipt of payment.

Availability

Because all our wall art is strictly limited edition, up to a maximum of 50 off each design, we cannot guarantee that pieces will always be available. When items are no longer available our website will be updated as soon as is reasonably practicable. We also reserve the right to discontinue items or refuse transactions at our sole discretion. You will not be charged for any order that cannot be fulfilled and where appropriate we will re-credit your account with any sum debited from it.

Product Description & Colour Reproduction

All our pieces are sold subject to their product description which sets out the specifications of that product. We will take all reasonable care to ensure that all details, descriptions and prices are correct at the time of publication. Please also note that whilst we try to ensure the colour accuracy of designs published on our website, this is subject to variations in and limitations of computer screen representations and the difference between these representations and the imaging processes used to create our pieces.

Payment & Pricing

We are able to accept payment, which must accompany your order, online by credit card or PayPal and offline by credit card, cheque, electronic funds transfer or, for overseas customers, international money order. All prices are exclusive of a standard packing and shipping charge of £20.00 + VAT per item for UK mainland deliveries [special offers and collections excepted]. This may vary according to the size, weight and destination of the ordered items. Any extra shipping charges will be confirmed when you make an enquiry or place an order. All prices quoted are inclusive of VAT which is charged at the current rate of 17.5% on all items shipped within the EU. Shipments outside of the EU may be subject to local import taxes - such taxes will be your responsibility. Where applicable, you will be contacted once goods are in customs to let you know if any duty is payable.

PayPal helps protect your credit card information with industry-leading security and fraud prevention systems. When you buy from Zixxi, PayPal never shares your financial information with us.

Shipping & Packing

We will endeavour to deliver goods within 10 days of order confirmation. However we do not offer compensation for late delivery unless the time since confirmation of your order exceeds 30 days. We accept no responsibility for full and correct address details not being supplied. If we think an order is likely to be delayed we will contact you via telephone or email. All goods are suitably packed and delivered by trusted third-party carriers on a 2-3 day service.

Returns Policy

Every piece of Zixxi wall art is bespoke and created specifically for you - we are therefore unable to offer you a refund or cancellation once your order has been accepted. This does not affect your statutory rights. If your goods are damaged or defective, you should notify us immediately upon receipt by telephone or email and confirm in writing within 7 days by email to: art@zixxi.com or by post to: Zixxi, Lower High Street, Tutbury, Staffordshire DE13 9LU, United Kingdom. We will replace the goods provided they are returned to us at your cost, in their original condition and with the despatch note.

All rights reserved. Any modification, distribution, or re-publication, without our prior written permission is strictly prohibited. By purchasing items from us you acquire only the rights of ownership to the physical goods and not any right to or interest in any copyright or intellectual property rights to the work nor the right the reproduce the same in part or whole.

Governing Law & Contract Formation

No contract will subsist between us and you for the sale by us to you of any product unless and until we accept your order in writing by letter or email. That acceptance will be deemed complete and for all purposes to have been effectively communicated to you at the time we correspond with you (whether or not you receive that correspondence). For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and we and you irrevocably submit to the non-exclusive jurisdiction of the English Courts.

To the fullest extent permitted at law, we are providing our service on an "as is" basis and make no (and expressly disclaim all) representations or warranties of any kind, express or implied, with respect to our service, information, content, materials or products including, without limitation, warranties of merchantability and fitness for a particular purpose.

In addition, we do not represent or warrant that such information is accurate, complete or current. Price and availability information is subject to change without notice. To the fullest extent permitted at law, neither we nor any of our affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of our service. This is a comprehensive limitation of liability that applies to damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, income or profit, loss of or damage to property and claims of third parties. We are committed to protecting your privacy. We only use the information collected via the website to make shopping with Zixxi possible.

What information do we collect and how do we use it?

When you place an order, we and our third party service providers need to know your name, postal and delivery addresses and payment details. This allows us and our third party service providers to accept, process and fulfil your order and to notify you of the status of your order. We/they also ask you for a telephone number or email address which enables us/them to contact you to arrange delivery or if there is a problem with your order. This information is also given to our carriers in case of any problems making your delivery. If you enter a competition or other promotional feature, we may ask for your name, address and email address so we can administer the competition and notify winners. We may also use the information we collect to occasionally notify you about new services and special offers we think you will find valuable. If you would rather not receive this information, you may opt out by contacting us via any of the channels contained in these Terms & Conditions.

Will Zixxi disclose the information it collects to outside parties?

We do not sell, trade or rent your personal information to others. We may choose to do so in the future with trustworthy third parties, but you can tell us not to via any of the channels contained in these Terms & Conditions. We employ other companies and individuals to perform functions on our behalf. Examples include receiving payments, fulfilling orders, delivering packages, sending postal mail and emails, removing repetitive information from customer lists, analysing data, providing marketing assistance and customer services. Such companies and individuals will only have access to the personal information needed to perform these functions, but may not use it for any other purposes and are required to process the data in accordance with the UK's Data Protection legislation.
